"An Old Matrimonial Suit. W. L. Powell v. Mary P. Powell and John Poile.
On June 17, 1863, this cause was tried in the Supreme Court, before the
late Chief Justice (His Honor Richard D. Hanson) and a Jury, when a
verdict was returned that the respondent, Mary Parker Powell, had
committed adultery, with the co-respondent John Poile. After the
verdict, the petitioner desired of his brother, Samuel Smith Powell,
now of Glenelg to do what was necessary to get the order dissolving his
marriage drawn up, he having left the province to reside in Canterbury,
New Zealand. Accordingly, Mr. Samuel S. Powell had an interview with
the late Talbot B. Brace, the Proctor, who acted for the petitioner in
the suit, and paid him his charges, which he said would include his
costs for drawing up the order or decree, dissolving the marriage of
the petitioner with the respondent. In an affidavit dated November
12th, 1888, Samuel S. Powell stated that he had that day been informed
for the first time that the order had not been drawn up. Mr. J.
Nicholson moved that the Court grant an order to dissolve the marriage.
He had made search, and found no record of the order being made. The
Chief Justice said the application was an extraordinary one. Had the
Judge's notes been found? Mr. Nicholson said he had not seen them. The
Chief Justice thought that they could be found. It was quite possible
that the order had been made. Motion adjourned to allow of further
search." (South Australian Register 14/11/1888).[5]
